Terms Of Service

Terms of Service ("Terms") govern your use of and access to our website (the "Site"), application (the "Application") and other services (collectively, the "Services").

The Services are provided by PeakShield VPN ("we", "us", "our" or "PeakShield"). Please note that the Terms constitute a binding legal agreement between you ("User" or "You") and PeakShield. By accessing our Website, installing and/or using the Services, you acknowledge that you have read and understood the Terms and agree to be bound by them. If you do not agree to these Terms or any provision thereof, please do not install the Application and do not use our Services. If you are accepting these Terms on behalf of your employer or other entity, you represent and warrant that (i) you have full legal authority to bind your employer or such entity to these Terms, and (ii) you are agreeing and consenting to these Terms on behalf of the party you represent.

1. General provisions

Our Services are virtual private network ("VPN") services that enhance Internet security and privacy.

order to use certain Services, you will need to set up an account. You are solely responsible for all use or activity that occurs under your account, including, but not limited to, any use of your account by anyone who uses it (whether or not authorised to do so), or by anyone who has access to the computer on which your account is located or accessible.

We do not record or store any logs of user activity using our services, but if you choose to create a user account, you will be required to provide some basic information, such as an email address and password. If you wish to subscribe to our premium services through the Official Site, you will be required to provide certain other information, such as billing information and country/address. You must maintain and update this information to be current, true, complete and accurate. You warrant that you have the right to provide such information. You authorise us to verify your information at any time. We reserve the right, in our sole discretion, to suspend or terminate your user account and your access to the Services if your information is found to be untrue, inaccurate, not current or incomplete.

You are responsible for maintaining the confidentiality of your account, username and password and for restricting access to your account. You may not share your password or other account access information with any other party on a temporary or permanent basis, and you agree to accept responsibility for all activities that occur under your account or password, whether or not authorised by you. You agree to notify us immediately of any unauthorised use of your account, username or password.

Your use of the Services is at your sole risk. We develop our Services by continually introducing new features or modifying existing features. The Services may be modified, updated, discontinued or suspended at any time without notice or liability. We are not responsible for any damages or other adverse consequences to you as a result.PeakShield, its owners, employees, agents and others involved in the Services are not liable in any way or form for any damages caused or intended to be caused by the use of any account registered on the Services.

2. Modifications

It is the responsibility of all users of the PeakShield Services to ensure that they are familiar with the latest wording of the Terms. Changes to the Terms may be notified to you by posting updated Terms on the PeakShield website, where the date of the most recent wording of the Terms is shown at the top of the page. Because you agree to be bound by these Terms each time you use the PeakShield Services, please consider reviewing these Terms each time you use the PeakShield Services. Each update to the Terms is effective from the time it is posted on this page. You understand and agree that by continuing to use and access the PeakShield Services after any updates to these Terms are posted, you voluntarily agree to be bound by the updated Terms.

3. Privacy Policy

We do not log any user activity (websites visited, DNS lookups, emails, etc.). We only log access attempts to our servers (for security and troubleshooting purposes). We do not engage in any form of censorship. We do not provide your personal information to any third parties except for the items described in our Privacy Policy. We will not cooperate with any request for information unless we are ordered to do so by a court of competent jurisdiction, and the vast majority of these requests do not come from a court of competent jurisdiction. We will protect you to the fullest extent possible, and our systems are set up to do so automatically. There are hundreds of good reasons for anonymity and we fully respect them.

4. Third party websites and services

We may provide you with content belonging to third parties ("Third Parties") or links to third party websites. We are not responsible for the availability of content provided by Third Parties because they are not controlled or supervised by PeakShield and may have different terms of use and policies. Your access to any website, service or content provided by a third party through our Services does not indicate the existence of any relationship between us and such third party.

In addition, from time to time, we may use services provided by other third parties, including computer software provided by third parties, which are used under terms provided by the third parties with the permission of their respective licensors and/or copyright holders. We expressly disclaim any warranty or other assurance to you with respect to such third party services.

5. Licence

Subject to the terms and conditions of these Terms, we grant you a limited, revocable, non-exclusive, personal, non-transferable, non-sub-licensable, fixed term licence to (1) download our Apps; (2) access the Website; and (3) use the Services, including, without limitation, the products and services available on or through our Apps or Website. We do not grant you any other rights or licences (express or implied) under the Terms in connection with the Services. The licence provided by these Terms is valid until terminated. This licence will automatically terminate if you do not comply with these Terms.

The Services (including, but not limited to, our applications and websites) are owned and copyrighted by PeakShield and are protected worldwide. We retain all right, title and interest in and to the Services and any portion thereof, including, without limitation, all copyrights, trademarks, service marks, patents, trade secrets and other intellectual property rights. You may not take any action that in any way jeopardises, restricts or interferes with our ownership and rights in the Services. All rights reserved unless otherwise noted.

In order to protect the Services from being misused or used to harm others, we reserve the right to take appropriate action when our Services are used in violation of these Terms and applicable law. You agree that if you misuse the Services, we may terminate your account or take any other legal action required by law without refunding fees paid for the Services. You agree that you may not:

- Send or transmit unsolicited advertising or content (i.e., "spam") through the Services.

- Send, post or transmit through the Services any Content that is unlawful, hateful, threatening, abusive or defamatory; infringes on intellectual property rights; violates privacy; or incites violence.

- Upload, download, post, reproduce or distribute any Content protected by copyright or other proprietary rights without the permission of the owner of the proprietary Content.

- Upload, download, post, reproduce or distribute any content that contains sexual or explicit depictions of minors.

- Engage in any conduct that restricts or inhibits any other subscriber from using or enjoying the Services.

- Attempt to access, probe or connect to computing devices without proper authorisation (i.e. any form of "hacking").

- Attempt to compile, utilise or distribute a list of IP addresses that PeakShield operates with the Services.

- Use the Services for any military purpose, including cyber warfare, weapons development, design, manufacture or production of missiles, nuclear, chemical or biological weapons.

- Infringe, violate or misappropriate the copyrights, other intellectual property rights, privacy or other legal rights of our licensors and/or any other third parties.

- Use the Services for any unlawful purpose.

7. Disclaimer

We make no representations or warranties about the completeness, accuracy, adequacy, suitability, functionality, availability or operation of the Services. you acknowledge that we have no control over your use of the services and we do not guarantee the performance or results that you may obtain from your use of the services. you assume all risk and liability for use of the services and for any loss or error in any data or information. to the fullest extent permissible by applicable law, we disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from a course of dealing or trade practice. Without limiting the foregoing, we neither warrant nor represent that your use of the Services will not infringe the rights of any third party, that the Services will be available for your access or use, or that the operation of the Services will be error-free or uninterrupted. please note that some jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In addition, you may have other rights that vary from jurisdiction to jurisdiction.

8. Limitation of Liability

your use of the service is at your sole risk. neither we nor any of its parents, subsidiaries or affiliates, nor any of its employees, officers or directors shall be liable for any direct, indirect, punitive, incidental, special, consequential or other damages (including, without limitation, any loss of data or information, loss of business, loss of profits, business interruption, insurance costs, or any other damages) arising out of or in connection with this agreement or the use of, or inability to use, the service. whether based on contract, tort, strict liability or otherwise, even if we have been advised of the possibility of such damages, and notwithstanding any other provision of law or regulation, and notwithstanding any other provision of law or regulation, your personal losses are not the responsibility of PeakShield.
